... And One Clause to find them..
...One Clause to bring them all..
...And in the darkness.. (legally) bind them...
... thats a lord of the rings reference for all the nerds out there. And that one clause is kind of the one ring of power Japan used to majorly reduce the population of the Yakuza, making it very difficult for their members ( and their children ) to open bank accounts, obtain property, do collaborative business with other organizations, etc.
Hi my name is David and I am mentally cornering all of my opponents in Tricking... which is basically anyone who intends to attack the sport by betraying it's integrity !! That's right I fight sports corruption, and that's just how it's gunna be !
To be precise, the title of the clause is usually something along the lines of " Elimination of Anti-Social Forces "
Here is an example of the clause, provided by an internet search:
"Party A and Party B represent and warrant that, now and in the future, neither they nor their officers are members of, affiliated with, or associated with organized crime groups, organized crime group members, companies affiliated with organized crime groups, corporate extortionists, or any other anti-social forces.
If either Party A or Party B breaches the foregoing representation, the other party may terminate this agreement immediately without prior notice."
... this means that in order to do legitimate business in japan, you literally cannot associate or affiliate and contribute towards any gangs.
Not exclusive to the Yakuza, either. Tokuryu, which is the modern day anonymity based crime group, is included ^^
So any sports organizations, any associations, any teams in Japan would regularly issue contracts in order to do legitimate business, with other seemingly legitimate organizations .. it would be important to ensure that you are doing your pro-active duty to not participate in any crime groups - be them overt or anonymity based, as it would be in your best interest !
I highly encourage the development of continued education and awareness regarding this topic, and the elimination of anti-social forces in Tricking.. because for all the people involved in Tricking who are participating in Japan, you could be breaking contracts.. and those are tough to defeat in court .. !
Common consequences:
In Japan, the consequences can be quite serious because these clauses are usually written to give the innocent party broad rights if a breach is discovered.
Typical consequences include:
1. Immediate termination of the contract
This is the most common consequence.
Many clauses specifically state that if a party is found to be:
- a member of an anti-social organization,
- acting on behalf of one,
- funding one,
- or maintaining prohibited relationships,
the other party may terminate the agreement immediately without notice.
For example:
- a real estate sale agreement,
- lease,
- bank account agreement,
- insurance policy,
- or business contract
may be cancelled.
2. Loss of deposits or contractual rights
Depending on the contract and circumstances:
- deposits may be forfeited,
- pending transactions may be cancelled,
- contractual benefits may be lost.
The exact outcome depends on the wording of the agreement.
3. Claims for damages
If the breach causes losses, the innocent party may seek compensation.
Examples:
- legal costs,
- transaction costs,
- business losses,
- reputational harm.
4. Banking consequences
Japanese banks take anti-social-force provisions very seriously.
If a bank discovers a customer falls within the prohibited categories, it may:
- close accounts,
- refuse services,
- terminate lending relationships,
- and decline future business.
5. Real estate consequences
In real estate transactions, discovery can result in:
- cancellation of the purchase agreement,
- refusal to complete title transfer,
- termination of leases,
- refusal of financing.
6. Corporate and employment consequences
For companies, the consequences can extend beyond a single contract:
- loss of business partners,
- termination of supplier agreements,
- exclusion from certain industries or projects.
so don't do it !
